1. Introduction

Welcome to Wilda. These Terms and Conditions ("Terms") govern your access to and use of the Wilda website, mobile applications, and services (collectively, the "Platform"). By accessing or using Wilda, you agree to be bound by these Terms.

Important: Wilda is a marketplace platform that connects safari tourists ("Renters") with licensed safari jeep owners ("Owners"). Wilda does not own any vehicles and is not a safari tour operator.

2. Definitions

  • "Platform" refers to the Wilda website and any related mobile applications or services.
  • "Renter" refers to any user who books a safari jeep through the Platform.
  • "Owner" refers to any person or entity that lists their safari jeep on the Platform.
  • "Booking" refers to a confirmed reservation made through the Platform.
  • "Service Fee" refers to the fee charged by Wilda for facilitating bookings.
  • "Safari Session" refers to a scheduled safari trip (morning, afternoon, or full day).

3. Account Registration

3.1 Eligibility

To use Wilda, you must be at least 18 years old and capable of forming a binding contract. By registering, you represent that you meet these requirements.

3.2 Account Responsibilities

You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or harm other users or the Platform.

4. Booking Terms

4.1 Making a Booking

When you make a booking through Wilda:

  • You are entering into a direct agreement with the Owner for the safari service
  • Your booking is subject to the Owner's acceptance
  • A service fee is charged at the time of booking to confirm your reservation
  • The remaining balance is paid directly to the Owner on the day of the safari

4.2 Booking Confirmation

A booking is only confirmed when:

  • The Owner accepts your booking request
  • The service fee payment is successfully processed
  • You receive a confirmation email/notification from Wilda

4.3 Accuracy of Information

You must provide accurate information when making a booking, including the number of guests, nationality (for park entry fees), and any special requirements. Inaccurate information may result in booking cancellation or additional charges.

5. Payments

5.1 Payment Structure

Our payment system works as follows:

Service Fee (Online)

A non-refundable service fee is paid at booking to confirm your reservation.

Safari Fee (On-site)

The remaining balance is paid directly to the Owner on the day of your safari.

5.2 Payment Methods

We accept major credit cards, debit cards, and other payment methods as displayed at checkout. All online payments are processed securely through our payment partners.

5.3 Currency

Prices are displayed in USD for international visitors. Local currency (LKR) pricing may be available for Sri Lankan residents. Exchange rates are determined at the time of transaction.

6. Cancellation and Refunds

Please refer to our Refund Policy for detailed information about cancellations and refunds. Key points include:

  • Cancellations made 48+ hours before the safari: Full service fee refund
  • Cancellations made 24-48 hours before: 50% service fee refund
  • Cancellations made less than 24 hours before: No refund
  • Weather-related cancellations: Full refund or free rescheduling

7. User Conduct

7.1 Prohibited Activities

You agree not to:

  • Provide false or misleading information
  • Violate any laws or regulations
  • Harass, abuse, or harm other users
  • Attempt to circumvent our payment system
  • Use the Platform for any illegal purpose
  • Interfere with the proper functioning of the Platform
  • Scrape, copy, or reproduce content without permission

7.2 Safari Conduct

During your safari, you must:

  • Follow all instructions from your driver/guide
  • Respect wildlife and maintain safe distances
  • Not feed or provoke animals
  • Remain seated in the vehicle unless instructed otherwise
  • Not litter or damage the natural environment
  • Comply with national park rules and regulations

8. Owner Responsibilities

Owners registered on Wilda agree to:

  • Maintain valid licenses and permits for safari operations
  • Keep vehicles in safe, roadworthy condition
  • Provide accurate descriptions and photos of their vehicles
  • Honor confirmed bookings
  • Arrive on time for scheduled safaris
  • Maintain adequate insurance coverage
  • Treat all renters with respect and professionalism

9. Limitation of Liability

Important Disclaimer: Safari tours involve inherent risks associated with wildlife and off-road travel. By using Wilda, you acknowledge and accept these risks.

Wilda acts as an intermediary platform and:

  • Does not own or operate any safari vehicles
  • Is not responsible for the actions of Owners or their drivers
  • Does not guarantee wildlife sightings
  • Is not liable for injuries, accidents, or losses during safaris
  • Is not responsible for third-party services (e.g., park entry fees)

To the maximum extent permitted by law, Wilda's total liability for any claim arising from your use of the Platform is limited to the service fees you have paid in the 12 months preceding the claim.

10. Intellectual Property

All content on the Wilda Platform, including text, graphics, logos, images, and software, is the property of Wilda or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works from any content without our express written permission. User-generated content (reviews, photos) remains your property, but you grant Wilda a non-exclusive license to use, display, and distribute such content on the Platform.

11. Dispute Resolution

In the event of a dispute:

  • Step 1: Contact our support team to attempt informal resolution
  • Step 2: If unresolved, submit a formal complaint through our dispute resolution process
  • Step 3: Mediation may be offered as an alternative to litigation
  • Step 4: Legal proceedings, if necessary, shall be governed by the laws of Sri Lanka

12. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be brought exclusively in the courts of Sri Lanka.
